By using and accessing the MBOX’s Services, which include but are not limited to the locker, mobile applications, and website, you acknowledge that you have read, understood, and agree to be bound by our Privacy Policy, which is supplementary and should be read in conjunction with our Terms and Conditions. Should you disagree to any of the terms, you should immediately discontinue use of MBOX service, locker, and any of its related APPs and website. Users must be of legal age and with the legal capacity to give binding consent, to use its services, website, and related apps.

1. Personal Data Collection

MBOX may collect personal data to be able to render our Services, and these data may include, personal information, full name, photo, identification cards, contact number, email address, delivery address, credit card/debit card/bank information, information concerning the products purchased (including product description, quantity and billing and delivery information), CCTV footage when using an MBOX locker, website access/usage data, transaction details with our partner couriers and other third parties, and any other information that may be reasonably required to facilitate the delivery of products to you and other individual recipients for the following purposes:

a. To provide and manage the services offered to you
b. To facilitate the creation and management of your user account
c. To assist you and respond to your inquiries, requests, and complaints
d. To ensure the safety and security of the products and services we offer to you
e. To prevent fraudulent and illegal activities
f. To allow you to participate in our marketing initiatives and to help us improve the services we offer to
you
g. To fulfill any obligations to you in coordination with other third-party service providers

2. Disclosure of Personal Data

3. Accessing and Updating Personal Information

MBOX implements appropriate measures to allow users to access, update, correct any of their provided personal information via our mobile app. For account security, MBOX may require verification of identity prior to granting you access to personal data.

4. Limitations and Indemnification Clause

a. MBOX is not liable and does not guarantee information provided in its services, website, and related apps by third parties, other links and system provisions of contractors and third party providers.
b. Credit card and other digital payment system are provided by third parties. The use of the system will forward and obtain information about you in relation to the payment system for authentication, authorization of payment, to help avoid fraud. We may suspend the transaction for valid reasons such as suspicious transactions, reports of fraud, authorization is unconfirmed or unavailable and other things. Payments of the orders shall be made in Philippine Peso, charges made by banks, financial institutions based on the conversion rate of the foreign credit cards or payment system, administrative fees will be for the account of the User.
c. MBOX will not be liable for any for any damage or loss arising from the use of its services, website, and related apps or linked site, including delays, failures, errors, interruption, defect, computer hacking or virus, line or system failures. Users must exercise discretion and diligence in the safety of their property, information and rights in the use of its services, website, and related apps.
d. No usage or activity herein should cause directly or indirectly to the threat, vexation, infringement or violation of rights, physical and data security, goodwill, property and/or liberty of other users, systems, or MBOX Smart Lockers Corp. Use of its services, website, and related apps shall be within the legal confines of good faith, good morality and practices, good customs and all applicable local and national Philippine and international laws.
e. MBOX will hold users responsible for damages, civil and criminal liability for the unauthorized use of its services, website, and related apps in violation of the Philippine and international laws.
f. Users agree to indemnify, defend and hold harmless MBOX Smart Lockers Corp. subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorney’s fees, directly or indirectly due to or arising out of your breach of these Privacy Policy and Terms and Conditions, or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

5. Intellectual Property Rights

Permission to use its services, lockers, website, and related apps does not include the appropriation of the material, content, trademarks, logos, and service marks which are all owned and under Copyright of MBOX or by authority of the owners thereof. Users of the site are prohibited from using the material, content or information on the site for commercial, public or other unauthorized purposes. This may include modifying, distributing, displaying, publishing, selling, licensing, creating derivative works from any material herein.

6. Governing Law

MBOX reserves the right to settle disputes arising from the use of its services, website, and related apps. This Privacy Agreement of Use shall be governed exclusively and subject to the Data Privacy laws of the Republic of the Philippines and all other pertinent Philippine laws, to the exclusion of other laws.

7. Data Retention and Security

MBOX retains personal data to fulfill the purposes for which it was collected, or as required by law.

  • Transaction data and CCTV footage may be retained for operational and legal purposes MBOX implements appropriate technical, organizational, and physical safeguards to protect personal data against unauthorized access, disclosure, or loss.
8. CCTV Monitoring

MBOX Smart Lockers are equipped with CCTV cameras positioned to monitor locker usage for security purposes.
CCTV footage may be used for:

  • Ensuring the safety and security of packages
  • Monitoring proper use of the lockers
  • Investigating incidents, disputes, or unauthorized access

By using the lockers, or any of our service and apps, users acknowledge and consent to such monitoring.

9. Data Breach Notification

In the event of a data breach that may pose a risk to users, MBOX shall take appropriate measures to mitigate the incident and notify affected users and the National Privacy Commission in accordance with applicable laws.
