Terms and Conditions of Use

MBOX Smart Lockers is a network of self-service lockers that are accessible 24/7, where Users can pick up, ship out, and store packages at their convenience. By using the services that MBOX provides, you accept and agree to the Terms and Conditions below and our Privacy Policy, which will be collectively referred to as “Terms of Service” hereafter.

I. Definitions

MBOX Smart Lockers Corp. is a corporation duly organized and existing under the laws of the Philippines with its principal office at 9th Floor Tower 1, DoubleDragon Plaza, DD Meridian Park, EDSA Extension, Bay Area, Pasay City (“MBOX”).

  1. MBOX, employees, and agents (“we”, “us”, “our”) provide services for customers through its “MBOX locker”, a self-service locker where customers can pick up, ship out, and store packages at their convenience. Our official website www.mbox.com.ph (“Website”), and our official mobile applications (“MBOX SMART LOCKERS APP” and “MBOX COURIER APP”) are also used to help our Users (“User”, “you”, and “your”).
  2. “Services” refers to the collective term for all the products, systems, networks, and services provided by MBOX, which include, but are not limited to, the MBOX locker, the MBOX mobile applications, and the MBOX website.
  3. “Package” pertains to any item that is allowed to be placed inside an MBOX locker by any of our Partner Couriers or registered Users.
  4. “Partner Couriers or Couriers” refers to our delivery partners that deliver to or collect packages from our MBOX lockers.
  5. “Personal Information” refers to information provided by Users to MBOX, which may include but are not limited to the User’s name, mobile number, email address, address, contact details, credit or debit card information, package information, and CCTV footage when using an MBOX locker.
  6. “User” refers to the Sender, Courier, Receiver, whether under a partnership agreement or otherwise, their principal, agents, representatives and affiliates.
  7. “Rates” refers to the published service rates, including overstay charges, published on the MBOX locker touchscreen (Click to view), and/or on the official MBOX website and/or through other official MBOX channels, as updated from time to time. The applicable Rates for each Package shall be those displayed or communicated to the User at or before the time the Package is deposited in the MBOX Smart Locker, and any subsequent change shall apply only to future transactions and shall not apply retroactively to Packages already deposited.
  8. “Free Stay Hours” refers to the pre-determined time or number of hours of stay from the time of package drop-off by a courier until its pickup that is allowed to be free of locker charges for the recipient, as published on the MBOX locker touchscreen (Click to view), and/or on the official MBOX website and/or through other official MBOX channels, as updated from time to time. The applicable Free Stay Hours for each Package shall be those displayed or communicated to the User at or before the time the Package is deposited in the MBOX Smart Locker, and any subsequent change shall apply only to future transactions and shall not apply retroactively to Packages already deposited. The recipient shall be made aware of the deadline of the Free Stay Hours of each package via SMS message or MBOX SMART LOCKERS APP message.

II. Application and Acceptance of Terms

  1. Our Terms of Service are binding and enforceable for all Users of the Services. By using our Services, Users warrant that they are of legal age and with the legal capacity to give binding consent to the terms of the Services. Access and use of our services is deemed acceptance and conformity to the Terms of Service and Privacy Policy.
  2. MBOX may at any time modify or amend its Terms of Service, and the modifications or amendments shall become effective upon publication on the MBOX Smart Locker, MBOX Smart Locker touchscreen, or website. Continued use of our Services means that the User agrees and accepts to be bound by our modifications or amendments.
  3. We may provide translations of our Terms of Service for your convenience, but should any conflict arise between the translated versions of our Terms of Service, the English version of our Terms of Service shall prevail and be the governing conditions.

III. Provision of Services

  1. MBOX only operates and maintains its Services and is not involved in the services provided by our Partner Couriers or any of our Users, which include but are not limited to the preparation, transportation, placement, and retrieval of your Packages.
  2. MBOX reserves the right, in its sole discretion, to deny access to and/or use of our Services to our Users at any given time and for any reason including for security, safety, operational, legal, fraud-prevention, misuse, non-payment, or suspected breach of these Terms of Service.
  3. User may be required to register in the MBOX mobile applications and provide some Personal Information to be able to access some of our Services.
  4. User acknowledges and agrees that there may be interruptions in the use of our Services due to maintenance procedures or due to circumstances beyond our control.
  5. While MBOX will exert the necessary efforts to consistently deliver its Services, it reserves the right to temporarily or permanently change, suspend, or disable any function or feature of its Services.
  6. MBOX lockers are subject to the following limitations.
    1. Packages that weigh more than 15 kg and/or larger than 14 inches x 12 inches x 19 inches cannot be placed inside an MBOX Smart Locker.
    2. The following items are prohibited to be placed inside the MBOX Smart Locker:
      • Currency, cash, payment cards, stored value instruments, negotiable instruments, securities, documents of title, vouchers, tickets, certificates, and similar items or documents representing monetary value or evidencing ownership of, or rights to, money, goods, or property;
      • Precious metals, precious stones, jewelry, watches, artworks, antiques, heirlooms, valuables, collectibles, or items of significant monetary or sentimental value;
      • Firearms, ammunition, explosives, incendiary devices, fireworks, pyrotechnics, weapons, weapon parts, or regulated arms;
      • Illegal drugs, dangerous drugs, controlled substances, controlled precursors, essential chemicals, drug paraphernalia, narcotics, or other prohibited substances under Republic Act No. 9165;
      • Hazardous, corrosive, flammable, combustible, radioactive, toxic, poisonous, infectious, biological, medical, pathological, or regulated chemicals, waste, materials, or substances;
      • Perishable goods, food, beverages, plants, animals, living creatures, biological materials, medical specimens, human or animal remains, wet ice, dry ice, or items requiring refrigeration, temperature control, special handling, or sanitation controls;
      • Wet, leaking, damaged, improperly sealed, contaminated, or odorous packages of any kind;
      • Regulated, restricted, age-restricted, imported, exported, or controlled items without all required licenses, permits, authorizations, or approvals;
      • Counterfeit, contraband, stolen, illegal, unlawful, or prohibited items under applicable law, public safety rules, marketplace rules, courier rules, or treaty obligations of the Philippines; and
      • Any item that may damage an MBOX Smart Locker, injure any person, interfere with the MBOX platform or services, delay or disrupt operations, affect other users, or create operational, legal, regulatory, sanitation, safety, security, or reputational risk.
  7. Access to the MBOX Smart Locker is dependent upon the conditions of the location. Details of the locations are available in our Website and/or MBOX mobile applications.
  8. Availability of MBOX Smart Lockers is subject to the volume of packages and Users.
  9. For Packages deposited by a Partner Courier, the package recipient must claim the Package within a maximum of thirty-two (32) consecutive hours from the time the Package is placed inside the MBOX Smart Locker, or within such other period as may be agreed between MBOX and the relevant Partner Courier (the “Maximum Claim Period”).

    After the Maximum Claim Period, the Partner Courier shall be responsible for retrieving the Package from the MBOX Smart Locker for return-to-sender (“RTS”) processing. If the Partner Courier fails to retrieve the Package for RTS within forty (40) hours after RTS is triggered, or within such other RTS retrieval period as may be agreed between MBOX and the relevant Partner Courier, MBOX may remove, or cause the Building Host or another authorized representative to remove, the Package from the MBOX Smart Locker for safekeeping or endorsement to the Partner Courier.

    If the Package remains unclaimed or cannot be endorsed after a reasonable holding period, it shall be treated as an Abandoned Package.

  10. For Packages deposited by Users other than Partner Couriers for storage purposes, the User or the User’s intended recipient must retrieve the Package within the storage period availed of by the User at the time the Package is deposited in the MBOX Smart Locker.

    If the User or the User’s intended recipient fails to claim the package within seventy-two (72) hours after the expiration of the applicable storage period, MBOX may remove, or cause the Building Host or another authorized representative to remove, the Package from the MBOX Smart Locker for safekeeping or endorsement to the User.

    If the Package remains unclaimed or cannot be endorsed after a reasonable holding period, it shall be treated as an Abandoned Package.

  11. A reasonable holding period means a period of up to thirty (30) days after removal from the MBOX Smart Locker, as determined by MBOX based on the nature of the Package, the applicable location or Building Host requirements, available storage capacity, safety or security concerns, and applicable law.
  12. MBOX may, subject to applicable law and the nature of an Abandoned Package, dispose of, donate, sell, return, or otherwise handle the Abandoned Package in a commercially reasonable manner. The User and/or Partner Courier shall remain responsible for all applicable fees, charges, storage costs, handling costs, return costs, and other costs incurred in connection with the Abandoned Package.

IV. Limitations of Liability

  1. MBOX shall not be held liable for any loss or damage caused by the following:
    1. The inaccurate information provided by the Users in the use of our Services;
    2. Any unfulfilled obligations due to force majeure, any act beyond our control, acts of God such as weather conditions, flood or earthquake, work stoppages, strikes, industrial disputes, war, any act of government (including delay or confiscation or detention of the Package by government authority), accidents, traffic obstructions or congestion, mechanical breakdown or other similar events;
    3. The Package contains illegal or prohibited item/s as indicated in Section 3.6.2 and by Philippine law; or
    4. Any other direct or indirect causes or consequences of the fault or negligence of the Users, Partner Couriers, or any other third party.
  2. Subject to applicable law, MBOX shall not be liable for losses arising from delays, failures, errors, interruptions, system or line failures, unauthorized access, unauthorized retrieval, or any User’s disclosure, sharing, misuse, or failure to secure account credentials, access codes, QR codes, PINs, OTPs, or other locker access details. Users are responsible for exercising reasonable care in using the Services and safeguarding their Packages and Personal Information.
  3. MBOX’s liability shall in all cases be limited to direct damages suffered by the User, and MBOX’s entire aggregate liability in connection with this Agreement shall be limited to the aggregate cost of your Packages in the transaction concerned or Php 1,000 (One Thousand Pesos) per transaction, whichever is lower. Our liability, however arising, and notwithstanding that the cause of any theft, loss, or damage be explained or unexplained, shall not exceed the replacement value of any goods stolen, lost, or damaged or Php 1,000 (One Thousand Pesos), whichever shall be lower. Any liability of MBOX shall be mitigated, if not extinguished, by the contributory fault or negligence of the User or Partner Courier.
  4. MBOX shall under no circumstances be liable for any loss (whether direct or indirect) of revenue, loss of profits or any consequential loss whatsoever as a result of the Services provided or for whatever reason under this Agreement.
  5. Any claim by any User against MBOX arising in respect of our Service shall be made in writing and notified to us within ten (10) days of the date upon which the User became (or should have become) aware of any event or occurrence alleged to give rise to such claim. Any such written claim shall include, at a minimum, the User’s name and contact details, the relevant locker location, transaction reference, description of the package, description of the issue, supporting documents, and such other information as MBOX may reasonably request for evaluation of the claim. MBOX shall review the claim based on its records and other available evidence. Any claim not made and notified as above shall be deemed waived and absolutely barred except where the User can show the impossibility of compliance within this time limit. Notwithstanding the aforementioned time limit, all liabilities to any claims of the User shall be discharged if the claim is brought fifteen (15) consecutive calendar days after the Service by which the claim arose was provided by MBOX.

V. Payment

  1. User shall pay all charges as and when they fall due in accordance with any relevant provisions in this Agreement.
  2. MBOX has the right to withhold its Services or a Package until full payment of any outstanding amount is paid by the User.
  3. MBOX reserves the right to change its Free Stay Hours and service rates from time to time, in accordance with the definitions of “Free Stay Hours” and “Rates” set out in Section I; provided, that the applicable Free Stay Hours and service rates for a Package shall be those displayed or communicated to the User at or before the time the Package is deposited in the MBOX Smart Locker, and any subsequent change shall apply only to future transactions and shall not apply retroactively to Packages already deposited.
  4. Payment prior to the performance of the Service is available for all customers. For payment prior to the Service performance, the payment will be collected from the User through our list of available electronic payments, such as, but not limited to, InstaPay, GCash, and Maya.
  5. QR Code payment data will be stored in our servers and processed by an accredited payment service provider. Such provider has (and will have) all necessary security certifications required by such payment service providers. Payment must be made/processed before the Package can be picked up from the MBOX Smart Locker.
  6. Overstay Fee Agreement
    1. User acknowledges and agrees that packages left in MBOX Smart Lockers beyond the Free Stay Hours will incur overstay fees according to the Rates.
    2. Overstay fees accrue immediately after the expiration of the Free Stay Hours and continue to accrue until the Package is retrieved. Notwithstanding the foregoing, MBOX may, in its sole discretion, waive or adjust overstay fees for verified MBOX system errors, locker malfunctions, payment processing issues, network outages, power interruptions, or other technical issues affecting retrieval.
    3. Overstay fees are charged in two (2) hour blocks after the expiration of the Free Stay Hours, and any portion of a two (2) hour block shall be charged as a full two (2) hour block. For example, if a package is retrieved thirty (30) minutes after the Free Stay Hours expire, the User will be charged one (1) two-hour overstay fee block.
    4. User agrees that packages cannot be retrieved from MBOX Smart Lockers until all applicable overstay fees are paid in full.
    5. MBOX reserves the right to adjust both overstay fee rates and the calculation method (including frequency of charges) from time to time, in accordance with Section 5.3.
    6. User acknowledges that MBOX may, but is not obligated to, provide courtesy notifications via SMS and MBOX SMART LOCKERS APP regarding approaching or exceeded Free Stay Hours.

VI. User’s Obligations

  1. Any Package that is placed inside an MBOX Smart Locker whether by User or by a Partner Courier on User’s behalf must be well-packaged for transportation and delivery and must comply with the limitations of the MBOX Smart Locker that can be found in Section 3.6.
  2. User agrees not to tamper with any of MBOX’s lockers and computer systems, and to not gain or grant unauthorized access to the aforementioned as well as to other Users’ accounts.
  3. Users must use the Services in good faith and in compliance with all applicable laws, rules, and regulations. Users must not use the Services in any manner that threatens, harasses, infringes, or violates the rights, privacy, data security, property, systems, goodwill, or lawful interests of MBOX, other Users, third parties, or service providers.
  4. User warrants that any Personal Information that is submitted to access our Services is true, accurate, and complete, and User agrees to receive notifications from us so that we may be able to provide User with the Services.
  5. User agrees that any Personal Information provided by the User may be collected, used, processed, and shared by MBOX, in accordance with its Privacy Policy and applicable law, with any of our Partner Couriers, senders, receivers, payment service providers, authentication and verification service providers, and other service providers or contractors, solely to the extent necessary for the purpose of fulfilling an obligation or service on User’s behalf, and with any authority for the purpose of crime prevention, investigation, and other related lawful purposes.
  6. By using our Services, User agrees to the Terms and Conditions of our Partner Couriers, and User recognizes that we do not have control over the Terms and Conditions of our Partner Couriers.
  7. User agrees to indemnify, defend, and hold harmless MBOX, its affiliates, and their respective officers, directors, employees, agents, contractors, service providers, and suppliers from and against claims, losses, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising from User’s breach of these Terms of Service or MBOX’s Privacy Policy, misuse of the Services, violation of law or third-party rights, inaccurate information, or activity related to User’s Account.

VII. Term and Termination

  1. MBOX reserves the right to terminate its Terms of Service anytime without prior notice.
  2. MBOX reserves the right, in its sole discretion, to withhold any of its Services to the User in question if the User breaches any Terms of Service, or is reasonably believed to have breached any Terms of Service, or is suspected of being involved in dishonest or fraudulent activities.

VIII. Stop Delivery Order or Return Order

Users (User-Sender, User-Courier, or User-Receiver) may stop the delivery of the package or return the package subject to the terms of their sending or receiving agreement. Provided, that when a stop delivery order was made by either the User-Sender or by the User-Courier, both the User-Sender and the User-Courier shall be jointly and severally liable for any fee or charge payable to MBOX for the use of the MBOX Smart Locker and MBOX shall charge according to the applicable published rates to the Users, regardless of the Stop Delivery or Return Order, and the following provisions shall apply:

  1. For stop delivery orders:
    1. User-Sender. Should the sender stop the delivery of the package (stop delivery order), the User-Sender shall coordinate with its corresponding User-Courier who shall be responsible to stop or hold the delivery of the package, and/or to retrieve the same from the MBOX Smart Locker in the event that the package was already deposited in the MBOX Smart Locker.
    2. User-Courier. Should the courier stop the delivery of the package, the User-Courier shall be solely responsible to retrieve the package from the MBOX Smart Locker before the receiver takes possession of the package.
  2. For return orders:
    1. User-Receiver. Receivers must first retrieve the package from the MBOX Smart Locker on or before the end of the designated period for retrieving such package from the MBOX Smart Locker. Return can only be processed once the User-Receiver secures a return slip from the sender or courier, which the User-Receiver will then use to return the package to its Sender through MBOX or alternate means allowed by the Sender. Provided, that the User-Receiver return arrangement is exclusively and solely under the agreement and responsibility of the User-Receiver and Sender/Courier.
  3. Users hereby acknowledge and warrant that they shall pay all fees and charges incurred for the use of the MBOX Smart Locker and that they shall hold MBOX free and harmless from any damage incurred by any of the Users due to such stop delivery order or return order.

IX. Right to MBOX Smart Lockers and Inspect Package Contents

  1. MBOX, at its sole and absolute discretion, reserves the right to open an MBOX Smart Locker holding User’s Package, and to access or remove the Package, in case of threats or danger to life or property, suspected prohibited items, violation of these Terms of Service, operational necessity including abandoned package removal, or at the proper and authorized request of a government agency or representative.
  2. User’s Package(s), at the request of government or of any regulatory authority, may be opened and contents inspected by such authorities at any time, even before acceptance for dispatch. MBOX is under no obligation to make good or compensate User for any damage or delay thereby caused to a package or its contents.

X. Prohibited Items, Inspection, and Enforcement

  1. Users and Couriers shall not deposit, store, transfer, or process any Prohibited Items, through the MBOX Smart Locker network. MBOX maintains a zero-tolerance policy for contraband, illegal goods, hazardous materials, unsafe goods, and other prohibited property, regardless of value, packaging, declared contents, or marketplace rules.

  2. MBOX reserves the right, at its sole discretion, to refuse or suspend any transaction, and to open, inspect, access, remove, store, transport, dispose of, or otherwise handle any Package where MBOX reasonably believes that the Package contains Prohibited Items, poses a health, safety, legal, or operational risk, violates these Terms, has been abandoned, or where such action is necessary to protect persons, property, or the integrity of the MBOX Smart Locker network, or to comply with applicable law or any lawful order or request of a court, government agency, or other competent authority. MBOX may preserve evidence, report the matter to the appropriate authorities, and take any other reasonable action necessary to protect its rights, users, the public, or the MBOX Smart Locker network.
  3. The User and/or Courier shall be solely responsible for any Prohibited Item deposited in an MBOX Smart Locker and shall reimburse MBOX for all reasonable costs and expenses incurred in connection with its inspection, handling, removal, storage, transportation, cleaning, decontamination, repair, disposal, reporting, or compliance with applicable law relating to such Prohibited Item. MBOX may suspend or permanently terminate the User’s and/or Courier’s access to the MBOX Smart Locker network for any violation of this Section, without prejudice to any other rights or remedies available under these Terms or applicable law. MBOX shall not be liable for any loss, damage, delay, or other consequence arising from any inspection or action taken under this Section, or in compliance with applicable law or any lawful order or request of a court, government agency, or other competent authority.

XI. Photographic and Data Records About Your Package

  1. Subject to our Privacy Policy, we may obtain and retain on record photographs of any Package tendered (whether or not accepted) as evidence of the condition of packages when they are tendered or while they remain in our care, custody, or control.
  2. Subject to our Privacy Policy and applicable law, we may obtain photographs or CCTV images of the person(s) receiving and sending packages at any MBOX Smart Locker. The photographs or CCTV images may be used as evidence (in the event of a claim or dispute), for security and fraud-prevention purposes, to verify sending or receipt, and / or to determine the condition of a Package when it was received (or sent). Camera images and CCTV footages will be retained for a maximum period of forty-five (45) to sixty (60) days from the date of collection, after which they will be deleted, unless a longer retention period is necessary in connection with a claim, complaint, dispute, investigation, or legal proceeding.
  3. We ensure that any personal data revealed to us about the User and/or the addressee will be processed solely for the purpose of performing the Service, and otherwise in accordance with our Privacy Policy, applicable law, and under conditions ensuring the security of processing of personal data.

XII. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

XIII. Intellectual Property Rights

All content, materials, software, interfaces, designs, website content, trademarks, logos, service marks, trade secrets, know-how, and other intellectual property used in connection with the Services are owned by MBOX, its affiliates, licensors, or other relevant rights holders, or are used with authorization. All rights not expressly granted under these Terms are reserved.

Users may not copy, modify, distribute, display, publish, sell, license, create derivative works from, reverse engineer, decompile, disassemble, or otherwise use any such materials or proprietary marks for commercial, public, or unauthorized purposes without prior written permission from the relevant owner.
